VILLAGE OF EAGLE

The Village Board of Trustees met in regular session at 7:00 p.m. on November 20, 2017 with Moore, Schukei and Meier present. Young and Rash were absent. The Agenda items listed thereon were sufficiently descriptive to give the public reasonable notice of the matters to be considered at the meeting. The Chairperson, at the beginning of the meeting, informed the public about the location of the posted current copy of the Open Meetings Act. Chairperson Moore named the three (3) areas where the agenda was posted as follows: Village Clerk’s Office, Eagle Fire & Rescue Department and Eagle State Bank.

Chairperson Moore opened the Public Hearing at 7:00 p.m. for the purpose of hearing testimony concerning a zoning change and amendment of the Eagle Zoning Map from I1 (Light Industrial) to I2 (Heavy Industrial) for Tax Lot 23 (Outside City) located in the Southwest Quarter of Section 21, Township 10 North, Range 9 East of the 6th Principal Meridian, Eagle, Cass County, Nebraska, containing 9.62 acres. Dave Halvorsen introduced himself as the property owner and said when he requested the first zoning change earlier in the year his plans for the property were for outdoor storage of campers, boats and trailers only. Halvorsen’s nephew, Ken Halvorsen, later inquired about moving his building located on 1st Street to this property after making a deal with Casey’s General Stores to purchase the existing land his building currently sits on. Halvorsen said after considering his options, he has decided to apply for a zoning to change to move his nephew’s building onto his property and use the remainder of the property as an outdoor storage facility. The Planning Commission met on November 14, 2017 and determined Ken Halvorsen’s automotive repair business would qualify under Heavy Industrial zoning Section 5.14.02 (27) Equipment rental, sales and repair. Halvorsen said there is no request for annexation, water, sewer or fire protection services with the application. Moore asked if there were any comments or questions from the public. There were no comments or questions from the public.

The public hearing was closed at 7:03 p.m.

Motion by Schukei, second by Meier, to approve zoning change from I1 (Light Industrial) to I2 (Heavy Industrial) for Tax Lot 23 (Outside City) located in the Southwest Quarter of Section 21, Township 10 North, Range 9 East of the 6th Principal Meridian, Eagle, Cass County, Nebraska, containing 9.62 acres. Voting: Ayes – 3. Motion carried.

Open Forum – Ron Schmidt (230 S. 5th St.) asked about the commercial real estate sign installed south of Highway 34. Moore said the property owner created a concept plan for his property and is listing the real estate for sale. Schmidt asked if anything official has been brought before the board regarding this property. Moore said no.

Motion by Schukei, second by Meier, to approve Christiansen Tree Service’s proposal to remove dead and diseased trees from Village of Eagle properties in the amount of $2,765.00. Voting: Ayes – 3. Motion carried.

Motion by Meier, second by Moore, to introduce Resolution 2017-15. Voting: Ayes – 3. Motion carried.

Chairperson Moore read Resolution 2017-15 entitled:

RESOLUTION NO. 2017-15


BE IT RESOLVED by the Village Board of the Village of Eagle, Nebraska as follows:

1. That Section 4-102 of the Policies of the Village of Eagle be amended to read as follows:

SECTION 4-102: The Village shall furnish work shirts at its expense and furnish up to $350.00 for the cost of additional work-related uniform apparel as defined in Section 6-101 to its regular full-time maintenance employees.

2. That Section 6-101 of the Policies of the Village of Eagle be amended to read as follows:

SECTION 6-101: Regular full-time employees of the Village are expected to maintain a high standard of dress and grooming. Clothing that is worn on the job should be in good taste and reflect the requirements of the working conditions. For that reason, the Village shall require the maintenance employee(s) to wear work shirts that the Village will provide at its expense per Section 4-102. Additionally, the Village will furnish up to but shall not exceed $350.00 for the cost of additional work-related uniform apparel for each maintenance employee in any fiscal year. The following items are the only items required and considered under this provision: jeans, light jackets, heavy jackets, caps, rain gear, gloves, coveralls and steel-toed shoes or boots. Steel-toed shoes or boots shall be worn at all times while employed by the Village.

3. That the original section 4-102 and 6-101 of the Policies of the Village of Eagle be amended and the same here are repealed.

Motion by Schukei, second by Meier, to adopt Resolution 2017-15. Voting: Ayes – 3. Motion carried.

Motion by Moore, second by Schukei, to appoint Travis Moore, Ray Young, Chad McNeese and Willa DiCostanzo to the Civic Center Feasibility Study Steering Committee. Voting: Ayes – 3. Motion carried.

Motion by Meier, second by Schukei, to approve minutes as typed for the previous meeting. Voting: Ayes – 3. Motion carried.
