VILLAGE OF EAGLE

January 3, 2017


The Village Board of Trustees met in regular session at 7:00 p.m. on January 3, 2017 with Moore, Young, Rash and Meier present. Schukei was absent. The Agenda items listed thereon were sufficiently descriptive to give the public reasonable notice of the matters to be considered at the meeting. The Chair, at the beginning of the meeting, informed the public about the location of the posted current copy of the Open Meetings Act. Chairperson Moore named the three (3) areas where the agenda was posted as follows: Community Building, Village Clerk’s Office, and Eagle State Bank.

Motion by Moore, second by Rash, to appoint Rick Hestermann as Building Inspector/Zoning Administrator. Voting: Ayes – 4. Motion carried.

Motion by Moore, second by Rash, to appoint John Surman to the Eagle Planning Commission. Voting: Ayes – 4. Motion carried.

Open Forum – No public comment.

Motion by Rash, second by Moore, to introduce Ordinance 2017-01. Voting: Ayes – 4. Motion carried.

ORDINANCE NO. 2017-01

AN ORDINANCE OF THE VILLAGE OF EAGLE, CASS COUNTY, NEBRASKA, TO CONFIRM THE SALE OF THE FOLLOWING DESCRIBED REAL ESTATE, TO WIT:
LOT 1, BLOCK 19 OF THE ORIGINAL TOWN OF EAGLE, CASS COUNTY, NEBRASKA, FOR THE SUM OF SEVEN THOUSAND FIVE HUNDRED ($7,500.00) DOLLARS, TO LARRY ROSEBERRY (ELITE CUSTOM TECHNOLOGY); TO PROVIDE FOR THE SEVERABILITY OF ANY SECTION, CLAUSE, PROVISION OR PORTION FOUND UNCONSTITUTIONAL OR INVALID; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE FOR THE PUBLICATION OF THIS ORDINANCE IN PAMPHLET FORM AND THE EFFECTIVE DATE THEREOF; AND TO PROVIDE THAT THIS ORDINANCE SHALL NOT BE MADE A PART OF THE MUNICIPAL CODE OF THE VILLAGE OF EAGLE, NEBRASKA.

Motion by Moore, second by Meier, to suspend the rules of three consecutive readings of Ordinance 2017-01. Voting: Ayes – 4. Motion carried.

ORDINANCE NO. 2017-02

AN ORDINANCE OF THE VILLAGE OF EAGLE, CASS COUNTY, NEBRASKA, TO AMEND CHAPTER 10, ARTICLE 1, SECTION 10-117, OF THE MUNICIPAL CODE OF THE VILLAGE OF EAGLE, NEBRASKA AS THE SAME RELATES TO THE HOURS OF SALE OF ALCOHOLIC BEVERAGES WITHIN THE VILLAGE’S CORPORATE LIMITS; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE FOR THE SEVERABILITY OF ANY SECTION, CLAUSE, PROVISION OR PORTION FOUND UNCONSTITUTIONAL OR INVALID; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE THAT THIS ORDINANCE SHALL BE PUBLISHED AND SHALL BE IN FULL FORCE AND TAKE EFFECT FROM AND AFTER ITS PASSAGE AND APPROVAL, AS PROVIDED BY LAW AND AS PROVIDED HEREIN; AND TO PROVIDE THAT THE PROVISIONS OF THIS ORDINANCE SHALL BECOME AND BE MADE A PART OF THE MUNICIPAL CODE OF THE VILLAGE OF EAGLE, NEBRASKA, AND THE SECTIONS OF THIS ORDINANCE MAY BE RENUMBERED TO ACCOMPLISH SUCH INTENTION.

Motion by Young, second by Rash, to approve R & J Concrete’s bid in the amount of $11,800.00 for repairs to exposed sewer outfall line pipe. Voting: Ayes – 4. Motion carried.

Motion by Rash, second by Young, to appropriate 15% of 2017 Highway Allocation dollars into the Street and Sidewalk Repairs Savings Account. Voting: Ayes – 4. Motion carried.

Motion by Rash, second by Meier, to approve a liquor license renewal for Casey’s General Store #2725 located at 310 Highway 34. Voting: Ayes – 4. Motion carried.

Motion by Young, second by Meier, to approve a liquor license renewal for Casey’s General Store #2968 located at 130 Highway 34. Voting: Ayes – 4. Motion carried.

Motion by Young, second by Moore, to approve a liquor license renewal for Eagle Grocery located at 545 South 4th Street. Voting: Ayes – 4. Motion carried.

Motion by Moore, second by Meier, to approve the removal of Andrew Lindquist and Alexis Mahloch as members of the Eagle Fire & Rescue Department. Voting: Ayes – 4. Motion carried.

Motion by Rash, second by Meier, to approve the removal of Jeffrey Dodd and Steve Niederhaus as members of the Eagle Fire & Rescue Department’s Eagle Raceway Roster. Voting: Ayes – 4. Motion carried.

Motion by Young, second by Meier, to approve Nick Nystrom and Roger Stubbendeck attending a free Water Operator continuing education class in Wahoo on January 18, 2017. Voting: Ayes – 4. Motion carried.

Motion by Moore, second by Young, to amend the July 4, 2017 Board of Trustees regularly scheduled meeting date to July 5, 2017. Voting: Ayes – 4. Motion carried.

Motion by Rash, second by Meier, to approve minutes as typed for the previous meeting. Voting: Ayes – 4. Motion carried.
